Key Terms
In these Terms & Conditions ("T&C"), capitalized words have the following meanings:
Customer: Any individual or entity who enters into a transaction for sale, purchase, or storage of Products with Sabayik SA.
Customer Service: The service team responsible for handling Customer inquiries and issues.
Sabayik SA: Sabayik SA, a company registered in Saudi Arabia.
GTC: General Terms and Conditions of Sale of Sabayik SA.
Order(s): All orders, including sale and purchase orders.
Order Confirmation: The confirmation sent by email or via Customer account upon acceptance of an Order.
Order Date: Date the Order is placed by the Customer.
Person of Contact: Individual designated by Customer if Customer is unreachable.
Product(s): All products offered on Sabayik SA’s Website and Mobile App (e.g., gold, legal tenders, minted coins, minted bars).
Website: www.sabayik.sa
Working Days: Days excluding weekends and public holidays recognized under applicable law.
Extent and Contractual Entities
By accessing or using the Website, Mobile App, and services of Sabayik SA, including placing Orders, the Customer agrees to be bound by these GTC. Any conflicting Customer terms are null unless expressly agreed in writing by Sabayik SA.
The Customer must be at least 18 years old, fully competent, and not under curatorship. One account per Customer is permitted.
Amendments to the GTC
Sabayik SA may amend the GTC at any time. Amendments take effect immediately upon publication on the Website unless otherwise specified. The version effective on the Order Date applies to that Order.
Account Creation and Customer Identification
Customers must create an account with accurate, complete, and current personal information.
Sabayik SA reserves the right to request documentation for identity verification at any time and may refuse or terminate accounts without explanation.
Required documents:
Individuals: Valid official ID, recent proof of address.
Companies: Registration certificate, articles of association, legal representative ID, proof of address, certified commercial register extract.
Customer Obligations
Customers agree to:
Use services lawfully and according to these GTC.
Provide truthful and updated information and promptly notify Sabayik SA of any changes.
Safeguard login credentials and immediately report loss or unauthorized use.
Bear responsibility for all activities under their account until notification of fraud is received by Sabayik SA.
Investment Risk and Advisory Information
Products offered involve investment in precious metals, which are subject to market price fluctuations and risks including potential loss of capital.
Sabayik SA does not provide investment advice or guarantee returns. Customers should seek independent financial or legal advice before investing.
Customers acknowledge that past price trends are not indicative of future performance.
Sabayik SA disclaims liability for any financial loss or damages arising from investments in Products.
Website and Application Information
Sabayik SA makes reasonable efforts to ensure that the Website and Mobile App content is accurate and up to date. However, it does not guarantee completeness or absence of errors.
The Website and App may contain links to third-party sites for convenience; Sabayik SA is not responsible for their content or practices.
Use of the Website and App is at the Customer's risk, and Sabayik SA disclaims liability for any direct or indirect loss from use or inability to use the platform.
Shipping Cost and Delivery
Shipping costs are calculated based on delivery location, Product type, size, and weight and are displayed at Order checkout before confirmation.
Customers are responsible for payment of shipping fees unless otherwise agreed.
Delivery schedules are estimates and subject to change due to logistics or force majeure.
Delivery risk passes to the Customer upon handover to the courier or delivery service.
Placing an Order with Sabayik SA
Orders may be placed via the Website, Mobile App, telephone, or other approved means.
Orders are final once confirmed by the Customer and accepted by Sabayik SA.
Sabayik SA reserves the right to refuse or cancel Orders in cases of suspected fraud, non-compliance, or market conditions.
Customers must provide accurate information when placing Orders and comply with payment terms.
Financial Settlement and Retention of Ownership
Full payment is required at Order confirmation using the accepted payment methods.
Ownership of Products remains with Sabayik SA until full payment has been received and cleared.
Until ownership transfer, Customers have no right to sell, pledge, or dispose of Products.
Sabayik SA reserves the right to repossess or refuse delivery of Products if payment defaults occur.
Liability Transfer, Shipping Procedure, and Tax Responsibilities
Risk and liability for Products pass to the Customer upon delivery or transfer to the carrier.
The Customer is responsible for inspecting Products upon receipt and reporting any damages or discrepancies within 48 hours.
Sabayik SA will assist with claims related to damaged or lost shipments but is not liable for shipping delays or losses caused by third-party carriers.
Customers bear all applicable taxes, customs duties, or import fees associated with delivery of Products.
Sabayik SA does not provide tax advice and Customers should consult local tax authorities for obligations.
Market Loss Policy
Sabayik SA does not assume any liability for losses resulting from market price fluctuations affecting the value of Products before, during, or after purchase.
Customers accept the inherent risk of holding Products subject to market volatility.
Standards for Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF)
Sabayik SA complies with all applicable Saudi Arabian AML and CTF laws and regulations.
Customer accounts are subject to verification, ongoing monitoring, and reporting as required by law.
Sabayik SA reserves the right to suspend or terminate accounts if suspicious activity is detected or if documentation is not provided upon request.
Customers must not use Sabayik SA’s services for any unlawful purposes, including money laundering or terrorism financing.
Return Policy
Due to the nature of the Products and market volatility, Sabayik SA does not accept returns or cancellations once Products are delivered.
Any issues with delivered Products must be reported within 48 hours of receipt. Failure to do so implies acceptance.
Contact and Updates
Customers can contact Sabayik SA Customer Service via email, phone, or the Website for support and inquiries.
Sabayik SA may send updates, newsletters, and notifications related to Products, services, or legal requirements to the Customer's registered contact details.
Customers may opt out of marketing communications by following the unsubscribe instructions provided in such messages.
Inheritance Procedure
In the event of a Customer’s death, legal heirs must provide appropriate documentation (death certificate, proof of inheritance or court order) to Sabayik SA to transfer ownership or close accounts.
Sabayik SA will cooperate with legal heirs subject to applicable laws and internal procedures.
Sabayik SA is not liable for delays or disputes arising from inheritance claims.
Complete Contract
These T&C, together with any Order Confirmations and Privacy Policy, constitute the entire agreement between Sabayik SA and the Customer.
No other terms, statements, or promises outside these documents shall have effect unless agreed in writing.
Effectiveness and Amendments
These Terms become effective upon publication on the Website.
Sabayik SA may modify, update, or supplement the Terms at any time, with such changes published online.
Continued use of services after changes constitutes acceptance of the updated Terms.
Customers are advised to review the Terms regularly.
Governing Law and Dispute Resolution
These T&C and all transactions are governed by Saudi Arabian law. Disputes fall under the exclusive jurisdiction of Saudi Arabian courts.
